Subject: Legal Notice for Demand of a sum of Rs. _______/- (_______) towards reimbursement of Leave Travel Concession (LTC) claim submitted by my client on _______.

Sir(s)/Madam(s),

Under instructions of my client Mr. _______, _______, _______., _______, _______, _______– _______ and for and on behalf of my said client, I do hereby serve upon you the following legal notice of demand to the following effects:

1. That my aforementioned client was appointed w.e.f. _______19_______ as ___________ at ___________. After 20 years of service in conservation he was retired on _______20_______ from ___________ Division as the ___________.

2. That as per the service terms, my client was eligible to receive Leave Travel Concession (LTC). On _______20_______he had submitted a claim of Rs. _______/- (Rupees _______) towards reimbursement of Leave Travel Concession (LTC) for which he had spent money from his pocket.

3. That the amount has not been reimbursed till date.

4. That my client had submitted a RTI application with the Public Information Officer, ___________ Divisional Office, Civil Station, ___________ seeking status of the reimbursement of LTC claim of Rs. ___________/- submitted by him on ___________ and the reason for the delay.

5. That on ___________ the State Public Information Officer and Senior Superintendent, ___________ informed my client that in order to reimburse the amount of LTC claimed by my client a demand was raised with the ___________ and he assured that the amount of LTC will be reimbursed to my client after they receive it.

6. It is pertinent to mention that my client had made various communications to different offices and given representations.

7. On ___________ he had sent a representation to the ___________ requesting to reimburse his LTC claim and other dues.

8. That on ___________ he had sent a representation to the Hon'ble Minister of Forests, Ministry of Kerala requesting him to do the needful to release his LTC claim and other dues.

9. The approach of the concerned officers shows that they are intentionally not releasing the amount of LTC to harass my client in the name of non availability of funds.

10. It is relevant to mention here that the Hon'ble Supreme Court in various Judgments held that non availability of funds is not a proper ground for Government departments to take shelter and deny rights of citizens.

Now by virtue of the present legal notice, you are hereby called upon to pay to my client a sum of Rs. ___________/- (___________ only) towards Leave Travel Concession (LTC) claimed by my client on ___________, within 15 days of the receipt of the notice, failing which I have been clearly instructed by my aforesaid client to initiate Criminal and Civil proceedings before the competent court of law against you in your personal as well as official capacity solely at your costs /risks/consequences without any further communication to you.

A copy of this Notice is kept intact in my office for record and further necessary.
